Terms and Conditions

Welcome to Simera App, managed by Evolution Paytech Network.

By accessing or using the App, you agree to comply with and be bound by these Terms and Conditions.

Please read this agreement carefully. By selecting "I accept the terms and conditions of service" or by logging into the Simera App service, you indicate that you have read and accept the Terms and Conditions of the Simera App services, including our Privacy Policy.

1. Principle of Legality

You must be at least 18 years old (or the legal age in your jurisdiction) to use this app. By using the Simera App, you represent and warrant that you meet these requirements.

2. Credit Card

The word "card" refers in this contract to the credit card issued in favor of the cardholder. It is a Visa brand card, duly certified in Virtual or Physical chip technology, which works as a highly secure means of payment, since the limit of use is determined by a voluntary and prior charge of money made on this card. The cardholder can decide how much money to have available for purchases and withdrawals, within the parameters pre-established by Simera App.

3. Account Registration

  • You must create an account to use certain features.
  • You agree to provide accurate, current, and complete information.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.

4. Services Provided

The app allows users to:

  • Store digital funds
  • Send and receive payments
  • Link bank accounts or cards
  • View transaction history

We may modify, suspend, or discontinue any part of the app at any time without notice.

5. Customer Obligations

All customers who use the digital services of Simera App accept and undertake to:

Comprehensive Identification (KYC)

Provide truthful and verifiable information for "Know Your Customer" forms, about the lawful origin of funds and the purpose of the business relationship.

File Update

The client must update their data annually or within fifteen (15) business days after a significant change in their transactional profile, income level, or legal representation.

Prohibited Use

  • Do not use the Simera App for illegal or unauthorized purposes.
  • Do not engage in fraudulent activity.
  • Do not interfere with or interrupt the functionality of the app.

6. Transactions

  • All transactions are final, unless otherwise required by law.
  • You are responsible for verifying the transaction details before confirming.
  • We are not responsible for improper transfers caused by user errors.

Operations carried out by entering the user and their personal access code are understood to have been carried out by the customer. The entry of said data is equivalent to the customer's signature, having identical legal effects.

Claims and Disputes

Any claim or dispute related to the use of the card must be reported to our customer service within 30 days of the date of the transaction in question.

Suspicious Transaction Report (ROS)

Simera App has a legal obligation to report unusual or unjustified transactions. Under the "Tipping-off" principle, Simera App is prohibited by law from informing the user about the existence or sending of such a report.

7. Fees

  • Certain services may incur fees.
  • Commissions will be disclosed before trades are completed.
  • We reserve the right to change fees at any time with prior notice.

8. Security

  • We implement reasonable security measures.
  • Notify us immediately of any unauthorized use.

Personal Passcode

You are responsible for protecting your device and account. The client's personal access code is secret, personal, and non-transferable. Disclosure to third parties and/or its use by them falls under the total and exclusive responsibility of the client.

9. Privacy

Customers shall at all times comply with all applicable laws, rules, and regulations in connection with the use of the Simera App. Customers shall not use the Simera App for any activity that violates any laws or regulations, including but not limited to the incorrect transmission of copyrighted material, the sending of threatening or obscene materials, or misappropriation or export of trade or national secrets.

Your use of the app is also regulated by our Privacy Policy, which explains how we collect, use, and protect your data.

10. Third-Party Services

The app can integrate with third-party services (e.g., banks, payment processors). We are not responsible for their performance or policies.

11. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability will not exceed the amount you have made through the Simera App in the last 12 months.

12. Termination

We may suspend or terminate your account at any time if:

  • The client fails to comply with all or any of the instructions given by the system for the use of the Simera App service.
  • The client fails to comply with all or any of their obligations arising from these terms and conditions.
  • Any event of expiration of the service provided for in these terms and conditions occurs.
  • Any rule or resolution issued by a competent authority prevents or prohibits the client from trading on any account opened with Simera App.
  • In the event of the closure of the account for any reason. Evolution Paytech Network will cease to provide the Simera App service without prior notice and without any liability at its expense.
  • In the event of any suspicion of fraudulent or illegal activity.

13. SMS and Email Notification Consent

By agreeing to these Terms and Conditions and providing us with your mobile number and email address, you expressly authorize us to contact you via text messages or emails related to your accounts, products or services, daily operations, and for notifications and alerts about your accounts or services with Simera App (e.g., transferring funds, improving your credit card security, notifications and alerts about your credit card purchases and withdrawals, among others).

14. Applicable Law

These Terms are governed by applicable laws without regard to principles of conflicts of law.

15. Changes to Terms, Conditions, and Policies

We may update these terms, conditions, and policies from time to time. Your continued use of the app following changes constitutes acceptance of the updated terms, conditions, and policies.

By using Simera App, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

All days are business days except Saturdays, Sundays, and U.S. federal holidays.

17. Digital Privacy and Cookies Policy

17.1. Collection of Personal Data

In accordance with the Law on the Protection of the Individual against the processing of Personal Data, the company collects data for legal and contractual purposes. This includes identification data, contact information, IP geolocation data, financial profiles, and biometrics for identity validation.

17.2. Use of Cookies and Tracking Technologies

Our platform uses technical and analytical cookies to guarantee the security of browsing and access to the Simera App. These allow detecting fraud patterns, access from unusual locations, and ensuring the integrity of funds, complying with technological risk management policies.

17.3. Use of Information

We use information for purposes permitted by law, such as servicing; communicating with you; improving our site, products, or services; legal compliance; risk control; information security; anti-fraud purposes; marketing or personalizing our products and services; tracking the use of the Simera App (such as number of visits and session duration) to evaluate the usefulness of our sites; and the use of read receipt notifications in our email communications.

17.4. Additional Cookies

Cookies is also a term used to describe other locally stored objects, such as cookies stored in an Adobe folder on your device. These cookies will not be deleted when you clear your browser cookies. We may use this technology for purposes such as information security and fraud prevention. We do not use this technology for online behavioral advertising.

17.5. Sharing Information

We may share information with service providers we work with, such as data processors and companies that help us market products and services to you. Where permitted or required by law, we may share information with additional third parties for purposes including responding to legal process.

17.6. Database and Retention

All information collected will be stored in automated databases with high encryption standards. In accordance with the Compliance Manual and current regulations, records will be kept for a minimum period of ten (10) years after the end of the commercial relationship.

18. Information Confidentiality Policy

18.1. Confidentiality Commitment

All staff and third parties linked to Simera App are subject to a duty of absolute confidentiality and professional secrecy with respect to customer data and their financial movements.

18.2. Restricted Access

Access to the client's digital file is limited exclusively to the Compliance Officer and authorized operational personnel, under internal audit protocols.

19. Authorization for Consultation of Information (Bureaus)

19.1. Authorization

The customer grants express, informed, and indefinite authorization to Simera App to consult their information in the Know Your Customer Information Center.

19.2. Authorization of Credit Protection Agencies

Simera App is authorized to make queries in databases of credit protection agencies to strengthen the due diligence process and verify the consistency between the declared economic capacity and the actual financial behavior.

19.3. Purpose of the Consultation

All information obtained will have the sole purpose of mitigating the risks of money laundering, terrorist financing, and financing of the proliferation of weapons of mass destruction (LPD/FT/FPADM).

20. Final Provisions and Penalties

20.1. Breach and Termination

The provision of false or incomplete information, or the refusal to update the due diligence file, will entitle Simera App to immediately suspend digital services and terminate the contract without liability for Evolution Paytech Network, proceeding to close accounts in accordance with compliance regulations.
